1. Who we are
This Privacy Policy explains how Flashies collects, uses and shares your personal information when you visit theflashies.com or buy from us.
The store is operated by Timon Hermes, trading as Flashies, Auf der Lehmkaute 1, 34560 Fritzlar-Züschen, Germany. We are responsible for your personal information (the "controller" under European data protection law). You can reach us at theflashies.shop@gmail.com.
2. Information we collect
Information you give us:
Contact details, such as your name, email address and phone number.
Order details, such as your shipping and billing address, the products you buy and your order history.
Payment information. Your payment is processed by our payment providers. We do not see or store your full card number.
Messages you send us, such as support emails, including photos or videos you send with a claim.
Information collected automatically:
Device and usage data, such as your IP address, browser type, device type, pages you view, products you look at, how you arrived at our store and actions you take on the site.
Cookie and similar data, as described in section 6.
Information from partners:
Shipping and tracking updates from our fulfillment partner and carriers.
Information from advertising and social media platforms, such as whether you came to our store from an ad or video.
3. How we use your information
To process and deliver your order, send order confirmations and tracking updates, and handle claims, replacements and refunds.
To answer your questions and provide customer support.
To prevent fraud and keep our store secure.
To run, analyze and improve our store.
To send you marketing emails or text messages, only if you have opted in.
To show you relevant ads and measure how well our ads work, where allowed by law and your choices.
To meet legal, tax and accounting obligations.
4. Who we share your information with
We do not sell your personal information for money. We share information only as needed with:
Shopify, which hosts our store and processes order data for us. You can read Shopify's privacy policy at shopify.com/legal/privacy.
Payment providers, such as Shopify Payments, PayPal or other options shown at checkout, to process your payment and prevent fraud.
CJ Dropshipping, our fulfillment partner based in China. To pack and ship your order, CJ Dropshipping receives your name, shipping address, phone number and order details. Your phone number is needed by carriers for delivery.
Shipping carriers, which receive the details needed to deliver your package.
Email and messaging providers, which send our order emails and, if you opted in, our marketing messages.
Advertising and analytics partners, such as TikTok and Meta (Facebook and Instagram), if their pixels are installed on our store, and analytics services such as Shopify Analytics or Google Analytics.
Authorities or other parties, if required by law, to protect our rights or in connection with a sale or transfer of our business.
5. Email and text marketing
We only send you marketing emails or text messages if you opt in, for example at checkout or through a sign-up form. You can unsubscribe at any time using the link in any marketing email, by replying STOP to a text message or by emailing theflashies.shop@gmail.com. You will still receive emails about your orders, such as confirmations and tracking.
6. Cookies, pixels and analytics
We and our partners use cookies and similar technologies to make our store work, remember your cart, understand how visitors use our site and show and measure ads.
If installed on our store, the TikTok Pixel and the Meta Pixel collect information about your visit, such as pages you view, products you add to your cart and purchases. TikTok and Meta use this to help us measure our ads and show ads to people who may be interested in our products. They may combine it with other information they hold about you, under their own privacy policies.
You can control cookies through our cookie banner, where shown, and through your browser settings. You can also manage ad settings in your TikTok, Facebook and Instagram accounts. Blocking some cookies may affect how our store works.
7. Your US state privacy rights
Depending on the state you live in, you may have the right to:
Know what personal information we collect about you and how we use and share it.
Access and receive a copy of your personal information.
Correct inaccurate personal information.
Delete your personal information.
Opt out of the "sale" or "sharing" of your personal information, of targeted advertising and of profiling.
Not be treated differently for using your privacy rights.
California residents (CCPA/CPRA): We do not sell your personal information for money. However, using advertising pixels such as the TikTok Pixel and the Meta Pixel may count as "selling" or "sharing" personal information for cross-context behavioral advertising under California law. You can opt out using the "Do Not Sell or Share My Personal Information" link on our website or by emailing theflashies.shop@gmail.com. We also honor Global Privacy Control (GPC) signals sent by your browser as an opt-out request. We do not knowingly sell or share the personal information of consumers under 16. In the last 12 months, we collected the categories of information described in section 2 for the purposes in section 3, and disclosed them to the categories of recipients in section 4. We do not use sensitive personal information to infer characteristics about you.
Residents of other states: Many other states, including Colorado, Connecticut, Virginia, Texas, Oregon and others, have similar privacy laws. We will honor your rights under the law of the state where you live.
To make a request, email theflashies.shop@gmail.com. We may need to verify your identity, for example by asking you to confirm details of your order. You can use an authorized agent to make a request for you. If we deny your request, you can appeal by replying to our decision, and we will respond within the time required by your state's law.
8. GDPR and international transfers
Because we are based in Germany, the EU General Data Protection Regulation (GDPR) may apply to how we handle your information. We process your information:
To perform our contract with you, such as processing and shipping your order.
Based on our legitimate interests, such as preventing fraud, keeping our store secure and improving it.
Based on your consent, such as for marketing messages and non-essential cookies and pixels. You can withdraw your consent at any time.
To meet legal obligations, such as tax and accounting rules.
Under the GDPR you have the right to access, correct, delete, restrict and port your information, to object to certain processing and to withdraw consent. You also have the right to complain to a data protection authority, for example the authority in the German state where we are based.
Your information is processed in several countries, including the United States, Germany, Canada (where Shopify has offices), Ireland and China, where our fulfillment partner is located. When information is transferred, we rely on appropriate safeguards where required, such as the European Commission's Standard Contractual Clauses.
9. How long we keep your information
We keep order and payment records for as long as required by tax and accounting laws, usually up to 10 years under German law.
We keep support messages and claim photos or videos for as long as needed to handle your request and any follow-up, and usually no longer than 3 years.
We keep marketing data until you unsubscribe or withdraw your consent.
Cookie and pixel data is kept for the periods set by each cookie or partner.
After that, we delete or anonymize your information.
10. Security
We use Shopify's secure platform and work only with trusted partners to protect your information. No system is completely secure, but we take reasonable steps to keep your information safe.
11. Children
Our store is not directed at children under 13, and we do not knowingly collect personal information from children under 13. Our product is intended for users aged 14 and older. If you believe a child under 13 has given us personal information, please contact us and we will delete it.
12. Changes to this policy
We may update this Privacy Policy from time to time. We will post the new version on this page with a new "Last updated" date.
