1. About these Terms

These Terms of Service ("Terms") apply to your use of the Flashies online store at theflashies.com and to every purchase you make there. The store is operated by Timon Hermes, trading as Flashies, Auf der Lehmkaute 1, 34560 Fritzlar-Züschen, Germany ("Flashies", "we", "us" or "our").

By using our website or placing an order, you agree to these Terms. Our Refund & Replacement Policy, Shipping Policy and Privacy Policy are part of these Terms.

Our store runs on Shopify. Payments are processed by third-party payment providers.

2. Who can order

Our store is for customers in the United States. We only ship to addresses in the 50 US states and Washington, D.C., as described in our Shipping Policy.

To place an order, you must be at least 18 years old or the age of majority in your state, or have the permission of a parent or guardian who agrees to these Terms.

You agree to give accurate and complete information when you order, including your name, email address, shipping address and phone number.

3. Our product

Flashies sells a retro-style mini digital camera that you can carry on a keychain. It comes in several color designs and is available as a single camera, a 2-camera bundle or a 4-camera Squad Pack.

The camera is made for casual, fun photos and videos. It is not a professional camera, and its photo and video quality reflects its small size.

Some product photos and videos, especially on social media, may be AI-generated or illustrative. Actual colors and details can vary slightly. We describe our product as accurately as we can, but small errors in descriptions or images can happen.

4. Age and safety

Flashies cameras are intended for users aged 14 and older. They contain small parts and a rechargeable lithium battery. They are not a toy. Keep the camera and its parts away from small children and pets.

To use the camera safely:

Charge it only with a suitable, undamaged charger and cable, and do not leave it charging unattended for long periods.

Keep it away from water, high heat and open flames.

Do not open, puncture, crush or modify the camera or its battery.

Stop using it if it gets unusually hot, swells, smells strange or is damaged.

Dispose of it according to your local rules for electronics and batteries, not in household trash.

Please respect other people's privacy and follow local laws when you take photos or videos of others.

5. Prices and payment

All prices are in US dollars. Shipping is free. Any applicable sales tax is calculated and shown at checkout.

You can pay with the payment methods shown at checkout. Payments are processed by our payment providers. We never see or store your full card number.

If a product is shown at a wrong price because of an obvious error, we may cancel the order and refund you in full, even after you received an order confirmation. We will let you know by email.

6. Discount codes

Discount codes, including codes shared in our social media videos, cannot be combined with bundle prices unless checkout shows that the combination is allowed. Only one discount code can be used per order unless stated otherwise. Discount codes have no cash value and may expire or be withdrawn at any time.

7. Orders

After you place an order, you will receive an order confirmation email.

We may refuse or cancel an order, for example if a product is unavailable, if there is a pricing error, if we suspect fraud, or if the shipping address is one we do not deliver to. If we cancel an order you have paid for, you will receive a full refund.

You can change or cancel your order within 12 hours of placing it, as long as it has not been processed yet. After 12 hours, or once your order has been processed, it can no longer be changed or canceled.

8. Shipping and delivery

Our Shipping Policy explains where we ship, delivery times and tracking. Delivery times are estimates. The risk of loss passes to you when your package is delivered to the shipping address you provided. Packages lost in transit are handled as described in our Shipping Policy and Refund & Replacement Policy.

9. Refunds and replacements

All sales are final. We replace or refund a camera only if it arrives defective or damaged, if you received the wrong design, or if a camera is missing from your order. You must contact us within 30 days of delivery. Full details are in our Refund & Replacement Policy.

10. Intellectual property

All content on theflashies.com, including the Flashies name and logo, text, graphics, photos, videos and the design of the website, belongs to us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, sell or use this content for commercial purposes without our written permission. You are welcome to share links to our website and share our social media posts using the normal sharing features of those platforms.

11. No affiliation with camera brands

Flashies is an independent brand. We are not affiliated with, endorsed by or sponsored by any camera manufacturer or camera brand. Any third-party names or trademarks that may appear on our website belong to their respective owners.

12. Use of our website

You agree not to misuse our website. This includes trying to hack or disrupt it, collecting data from it with automated tools, placing fraudulent orders or using it for anything illegal. We may block access to our website or cancel orders if these Terms are broken.

13. Third-party services

Our store uses third-party services such as Shopify, payment providers, shipping carriers and social media platforms. Their own terms and privacy policies apply when you use them. We are not responsible for the content of third-party websites linked from our store.

14. Disclaimer

We promise that your camera will arrive working, undamaged and in the design you ordered, as described in our Refund & Replacement Policy. Beyond that, and to the extent permitted by law, our website and products are provided "as is" and we make no other promises or warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

15. Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, such as lost profits or lost photos and videos, arising from your use of our website or products.

To the extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, for intentional misconduct or gross negligence, for fraud, under product liability laws, or for any other liability that cannot be limited by law. Some states do not allow certain warranty exclusions or limits on damages, so some of the limits above may not apply to you.

16. Governing law and disputes

These Terms and all purchases from our store are governed by the laws of the Federal Republic of Germany, without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you are a consumer, this choice of law does not take away any protection you have under the mandatory consumer protection laws of the US state where you live.

If you have a problem with your order, please contact us first at theflashies.shop@gmail.com. We will try to solve it with you within 30 days. If we cannot solve it, you may bring your claim in a competent court, including the courts where you live or a small claims court. These Terms do not require arbitration and do not take away your right to go to court.

17. Changes to these Terms

We may update these Terms from time to time. The version shown on our website when you place an order applies to that order.

18. Other terms

If any part of these Terms is found invalid or unenforceable, the rest remains in effect. If we do not enforce a right immediately, we do not give it up. These Terms, together with the policies named above, are the entire agreement between you and us about your use of our store.
